The content and information on this Web site (including, without limitation, price and availability of travel services) and the infrastructure used to provide such content and information, is proprietary to Ghana Tours Ltd. or its suppliers and providers. Accordingly, as a condition of using this Web site, you agree not to use this Web site or its contents or information for any commercial or non-personal purpose (direct or indirect), except as an authorised agent of Ghana Tours. While you may make limited copies of your travel itinerary (and related documents) for travel or services purchased through this Web site, you agree not to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or re-sell any information, software, products, or services obtained from this Web site. In addition, whether or not you have a commercial purpose, you agree not to:

INDEMNIFICATION
You agree to defend and indemnify Ghana Tours Ltd., its affiliates, and/or their respective suppliers and any of their officers, directors, employees and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by
(i) you or on your behalf in excess of the liability described above; or
(ii) by third parties as a result of (a) your breach of these Web Site Terms, Conditions and Notices or the documents referenced herein;
(b) your violation of any law or the rights of a third party; or
(c) your use of this Web site.

TERMS, CONDITIONS AND WARRANTIES
Tax Recovery Charge
The tax charge on Ghana Tours Special Rate hotel transactions is a recovery of all applicable transaction taxes (e.g. sales and use, occupancy, room tax, excise tax, value added tax, etc) that Ghana Tours Travel pays to the vendors (e.g. hotels, etc.) in connection with your travel arrangements.
Ghana Tours is not the vendor collecting and remitting said tax to the applicable tax authorities. The vendors bill all applicable taxes to Ghana Tours and Ghana Tours remits such tax directly to the vendor. Ghana Tours is not a co-vendor associated with the vendor with whom we book or reserve our customer's travel arrangements.
Taxability and the appropriate tax rate vary greatly by location. Ghana Tours actual tax cost paid to the vendor may vary from the tax recovery charge, depending upon the rates, taxability, etc. in effect at the time of the actual use of the hotel, automobile, etc. by our customer.
Service Fee
These fees cover the costs incurred by Ghana Tours in servicing your travel reservation.
BY OFFERING FOR SALE TRAVEL TO PARTICULAR INTERNATIONAL DESTINATIONS, GHANA TOURS LTD. DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH POINTS IS ADVISABLE OR WITHOUT RISK, AND IS NOT LIABLE FOR DAMAGES OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS.

MODIFICATION OF THESE TERMS AND CONDITIONS
Ghana Tours Ltd. reserves the right to change the terms, conditions, and notices under which this Web site is offered and you agree to accept and be bound by those terms, conditions, and notices that are in effect at the time of your use of Ghana Tours Website and facilities.
GENERAL
This agreement is governed by the laws of the United Kingdom. You hereby consent to the exclusive jurisdiction and venue of courts in the United Kingdom, in all disputes arising out of or relating to the use of this Web site. Use of this Web site is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including, without limitation, this paragraph.
You agree that no joint venture, partnership, employment, or agency relationship exists between you and Ghana Tours Ltd. as a result of this agreement or use of this Web site.
Ghana Tours Ltd.'s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Ghana Tours Ltd.'s right to comply with law enforcement requests or requirements relating to your use of this Web site or information provided to or gathered by Ghana Tours Ltd. with respect to such use.
If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and agreement shall continue in effect.
This agreement (and any other terms and conditions referenced herein) constitutes the entire agreement between the customer and Ghana Tours Ltd. with respect to this Web site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between the customer and Ghana Tours Ltd. with respect to this Web site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
Fictitious names of companies, products, people, characters, and/or data mentioned herein are not intended to represent any real individual, company, product, or event.

BOOKING CONDITIONS

Ghana Tours are established tour operators and the air holidays and flights in this brochure are ATOL Protected. Our ATOL number is ATOL 4724. In the unlikely event of our insolvency, the CAA will ensure that you are not stranded abroad and will arrange
to refund any money you have paid to us for an advance booking. For further information, visit the ATOL website at
www.atol.org.uk.

In the following conditions the term 'company' means Ghana Tours and the term 'customer' means the person signing the booking form and all other persons on whose behalf he or she signs it. These conditions apply to all bookings accepted by the company, except that paragraphs 3, 6, 8(i) and 9 do not apply to flights-only bookings.

1. How to make a booking
Once you have decided on your itinerary, discuss your plans with your Travel Agent who will then call us to make a booking. You could also call us direct on +44 870 3455480 (London Office), +233 21 257581 (Accra Office) or fax us on +44 207 064 1264. You could email us at
sales@ghanatours.co.uk. Once reservations have been made, complete the booking form which your Travel Agent must forward to Ghana Tours along with the applicable payment. A confirmation of your booking will be sent to your agent within 14 days of your booking being confirmed. Such confirmation will also be set via fax, mail or verbally if you choose to call us direct. This will confirm that Ghana Tours has entered into a contract with you to provide all the components of the holiday you have booked. This contract is made on the terms of these booking conditions, which are governed by English Law, and the jurisdiction of the English Courts.

If the Travel Agent is authorised to act as our agent it will issue an ATOL Receipt on Ghana Tours behalf for any monies paid. Any money you pay to the Travel Agent before we have issued our confirmation invoice will be paid as an indication of your intention to enter into a contract with us and your money will immediately be protected by our ATOL bond. When you receive the confirmation please check the details carefully and inform us immediately if anything appears to be incorrect. You will note the date by which the final balance is due if you are not paying immediately in full. No further reminder will be sent.

2. Deposits and Payment
A minimum deposit of £250 per person* is required at the time of booking (plus insurance premiums if applicable). If the booking is not confirmed (by written acceptance by the company) and a suggested alternative is not considered acceptable, the deposit or full amount will be refunded. For bookings made within 8 weeks of departure immediate
full payment is required. For bookings made earlier, final payment is required not later than 8 weeks prior to departure. If the balance is not paid in time we shall retain your deposit. Due to the complex nature of many of the itineraries that Ghana Tours construct, a number of external suppliers provide services and packages for which separate and additional deposits apply. In these instances you will be advised of the necessary deposits at the time of booking.

3. Surcharges and price alterations
All prices quoted in this brochure are based on air fares and Exchange Rates as at 24th December 2004.
The price of your travel arrangements can be varied due to changes in transportation costs such as fuel, scheduled airfares and any other airline cost changes which are part of the contract between airlines (and their agents) and the tour operator or organiser. Also government action such as changes in VAT or any other Government imposed changes and currency changes in relation to an exchange rate variation.

In the case of any relevant variation, an amount equivalent to 2% of the price of your travel arrangements, which excludes insurance premiums and any amendment charges, will be absorbed or retained. Only amounts in excess of this 2% will be surcharged or re-paid. In either case there will be an administration charge of £1.00 per person together with an amount to cover agents' commission. If this means that you have to pay an increase of more than 10% of the price of your travel arrangements, you may cancel your travel arrangements and receive a full refund of all monies paid, except for any premium paid to us for holiday insurance and any amendment charges. Should you decide to cancel for this reason, you must exercise your right to do so within 14 days from the issue date printed on your final invoice. Whether you cancel or not you will also be entitled, on the terms set out in respect of major changes in paragraph 6 below, to accept an offer of alternative travel arrangements from us if we are able to do so and compensation as set out below. Please note that travel arrangements are not always purchased in local currency and some apparent changes have no impact on the price of your travel due to contractual and other protection in place.

4. If You Change Your Booking
If, after our confirmation invoice has been issued, you wish to change your travel arrangements in any way, for example your chosen departure date or accommodation, we will do our utmost to make these changes but it may not always be possible. Any request for changes to be made must be in writing from the person who made the booking or your travel agent. You will be asked to pay an administration charge plus any cost we incur in making this alteration. There may be a possibility that changes could not be made for instance where a charter seat has been made firm and the airline paid. This invariably will be the case.

5. If You Cancel Your Holiday
You may cancel your travel arrangement but cancellation penalty would apply. If the reason for your cancellation is covered under the terms of your insurance policy, you may be able to reclaim these charges.

6. If We Change or Cancel Your Holiday
It is unlikely that we will have to make any changes to your travel arrangements, but we do plan the arrangements many months in advance. Occasionally, we may have to make changes and we reserve the right to do so at any time. Most of these changes will be minor and we will advise you or your travel agent of them at the earliest possible date. We also reserve the right in any circumstances to cancel your travel arrangements. For example, if the minimum number of clients required for a particular travel arrangement is not reached we may have to cancel it. However, we will not cancel your travel arrangements less than 8 weeks before your departure date, except for reasons of force majeure or failure by you to pay the final balance. If we are unable to provide the booked travel arrangements, you can either have a refund of all monies paid or accept an offer of alternative travel arrangements of comparable standard from us, if available (we will refund any price difference if the alternative is of a lower value). If it is necessary to cancel your travel arrangements, we will pay to you compensation as set out in this clause.

Please note that carriers such as Airlines used in the brochure may be subject to change. Such a change is deemed to be a minor change. Other examples of minor changes include alteration of your outward/return flights by less than 12 hours, changes to aircraft type, change of accommodation to another of the same standard.

If we make a major change to your holiday, we will inform you or your travel agent as soon as reasonably possible if there is time before your departure. You will have the choice of either accepting the change of arrangements, accepting an offer of alternative travel arrangements from us if available (we will refund any price difference if the alternative is of a lower value), or canceling your booked holiday and receiving a full refund of all monies paid.  In all cases, except where the major change arises due to reasons of force majeure, we will pay compensation as detailed below:

Force Majeure: This means that we will not pay you compensation if we have to cancel or change your travel arrangements in any way because of unusual or unforeseeable circumstances beyond our control. These can include, for example, war, riot, industrial dispute, terrorist activity and its consequences, natural or nuclear disaster, fire, adverse weather conditions.


7. If You Have A Complaint
If you have a problem during your holiday, please inform the relevant supplier (e.g. your hotelier) and our local representative immediately who will
endeavour to put things right. If your complaint is not resolved locally, please follow this up within 28 days of your return home by writing to our Customer Services Department at 229A Old Kent Road, London SE1 5LU, giving your booking reference and all other relevant information. Please keep your letter concise and to the point. This will assist us to quickly identify your concerns and speed up our response to you.

It is strongly suggested that you communicate any complaint to the supplier of the services in question as well as to our local representative without delay.

If you fail to follow this simple procedure we will have been deprived of the opportunity to investigate and rectify your complaint at the time and this may affect your rights under this contract.

8. Our Liability to You

(i) We accept responsibility for ensuring that your travel arrangements, which you book with us, are supplied as described in this website and our brochure. If any part of your travel arrangements are not provided as promised, due to the fault of our employees, agents or suppliers we will pay you appropriate compensation if this has affected the enjoyment of your travel arrangements. Subject to paragraph (i) below our liability in all cases shall be limited to a maximum of 3 times the costs of your travel arrangements.

(ii) We accept responsibility for death, injury or illness caused by the negligent acts and/or omissions of our employees or agents, our suppliers and sub-contractors, whilst acting within the scope of, or in the course of their employment in the provision of your travel arrangements. We will accordingly pay to you such damages as might have been awarded in such circumstances under English Law or the law you have chosen under clause 1 above.

(iii) In respect of travel by air, sea and rail, and the provision of accommodation our liability will be limited in the manner provided by the relevant international convention. You can ask for copies of these international conventions from our Customer Services Department at 229A Old Kent Road, London SE1 5LU.

9. Personal Injury Unconnected With Your Booked Travel Arrangements
If you, or any member of your party, suffer death, illness or injury whilst overseas arising out of an activity which does not form part of your package travel arrangements or an excursion arranged through us, we shall at our discretion, offer advice, guidance and assistance.

10. Conditions of Carriage
The Contractual terms of the companies that provide the transportation for your travel arrangements will apply to this contract. These may contain terms which affect your rights to compensation. You may ask for copies of the relevant conditions of carriage from our offices.

This website is our responsibility, as your tour operator. It is not issued on behalf of, and does not commit the airlines mentioned herein or any airline whose services are used in the course of your travel arrangements. Please note that in accordance with Air Navigation Orders in order to qualify for infant status, a child must be under 2 years of age on the date of its return flight.

11. Brochure particulars
Please note that every care has been taken to ensure that all particulars shown in this website are accurate, but we reserve the right to change any particulars if necessary. We will advise you of any such changes prior to booking. Please note that all products featured in this website are subject to availability at time of booking.

12. Data Protection Policy
In order to process your booking and to ensure that your travel arrangements run smoothly and meet your requirements we [and your travel agent] need to use the information you provide such as name, address, any special needs/dietary requirements etc.

We take full responsibility for ensuring that proper security measures are in place to protect your information. We must pass the information on to the relevant suppliers of your travel arrangements such as airlines, hotels, transport companies etc. The information may also be provided to security or credit checking companies, public authorities such as customs/immigration if required by them, or as required by law.

We will not however, pass any information, onto any person not responsible for part of your travel arrangements. This applies to any sensitive information that you give to us such as details of any disabilities, or dietary/religious requirements. (If we cannot pass this information to the relevant suppliers, we cannot provide your booking. In making this booking you consent to this information being passed on to the relevant persons).
